1. Acceptance of Terms

By creating an account or otherwise accessing FeedbackAI ("the Service"), operated by CuevaLab ("we", "us", or "our"), you confirm that you are at least 16 years of age and agree to these Terms and Conditions and our Privacy Policy. If you do not agree, you may not use the Service.

2. Description of Service

FeedbackAI is an AI-powered feedback management platform that allows teams to collect, classify, cluster, and analyse user feedback. The Service includes a web application, API access, and integrations with third-party tools such as Slack.

The Service is currently provided free of charge during a beta testing period. We reserve the right to introduce paid plans in the future. Existing users will be given reasonable notice before any pricing changes take effect.

3. Beta Status

FeedbackAI is currently in beta. This means the Service is still under active development and may contain bugs, experience downtime, or undergo significant changes. We make no guarantees regarding uptime, data retention, or feature stability during the beta period.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately if you become aware of any unauthorised use of your account. We cannot and will not be liable for any loss or damage arising from your failure to protect your login information.

You may only create one account per person unless otherwise authorised. Accounts are non-transferable.

5. Acceptable Use

You agree not to use the Service to:

• Upload, post, or transmit any content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
• Violate any applicable local, national, or international law or regulation.
• Attempt to gain unauthorised access to any part of the Service or its related systems.
• Reverse-engineer, decompile, or disassemble the Service or any portion of it.
• Use the Service to send spam, phishing messages, or other unsolicited communications.
• Scrape or harvest data from the Service without our express written permission.
• Interfere with or disrupt the integrity or performance of the Service.

6. Data & Privacy

By using the Service you grant CuevaLab a limited licence to store and process the feedback data, embeddings, and metadata you submit solely to provide the Service to you. We do not sell your data to third parties.

All data is scoped to your organisation and is not accessible by other organisations using the platform. We employ industry-standard security measures including encrypted connections, hashed credentials, and role-based access control.

During the beta period we may aggregate anonymised usage statistics to improve the product. You may request deletion of your account data at any time by contacting [email protected].

7. Intellectual Property

The Service, including all software, design, text, graphics, and other content created by CuevaLab, is and remains the exclusive property of CuevaLab and is protected by applicable intellectual property laws. You retain all rights to the feedback data you submit.

8. Third-Party Services

The Service integrates with third-party services including Slack and various AI providers. Your use of those services is governed by their respective terms of service. CuevaLab is not responsible for the availability, accuracy, or practices of any third-party service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated outputs will be accurate.

10. Limitation of Liability

To the fullest extent permitted by applicable law, CuevaLab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or relating to your use of the Service, even if CuevaLab has been advised of the possibility of such damages.

11. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "last updated" date at the top of this page and, where appropriate, notify users by email or via the application. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the jurisdiction where CuevaLab is registered.
